Welcome to Emoti Craft! These Terms of Service (" Agreement ") govern your use of the Emoti Craft platform and services (" Services "). Please read these terms carefully.

By accessing or using Emoti Craft, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Account Registration & Google Sign-In

To use Emoti Craft, you may be required to sign in with Google. By doing so, you grant us permission to access your name, email address, and profile picture as per Google's authentication policies.

You are responsible for safeguarding your account credentials and ensuring no unauthorized access occurs.

2. Use of the Service

Emoti Craft allows users to generate AI-powered emojis.

• Free Users: Can generate 1 emoji for personal, non-commercial use.
• Paid Users: Can generate unlimited emojis for both personal and commercial use.

You agree not to:

• Abuse or misuse the Services.
• Attempt to hack, disrupt, or interfere with our platform.
• Use generated emojis in illegal, defamatory, or harmful ways.
• Sell, redistribute, or exploit any emojis without a valid paid subscription.

3. Intellectual Property

All content, code, logos, and branding on Emoti Craft belong to us and are protected under copyright and trademark laws.

• Free users may use their generated emojis for personal use only.
• Paid users may use their generated emojis for commercial purposes but do not own the AI model or platform.
• Unauthorized use of Emoti Craft's branding or assets is strictly prohibited.

4. Payment & Subscriptions

• Payments for the unlimited emoji plan are processed by a third-party provider.
• Subscriptions automatically renew unless canceled before the next billing cycle.
• No refunds are provided for the current billing period after cancellation.

5. DMCA & Copyright Compliance

If you believe any generated emoji infringes your copyright, please submit a Takedown Request to support@emoticraft.com with:

• A description of the copyrighted work.
• Identification of the infringing material.
• Your contact details.
• A statement of good faith belief that the use is unauthorized.

We may remove infringing content and take action against repeat offenders.

6. Dispute Resolution & Governing Law

All legal claims related to this Agreement will be governed by California, USA law.

• Disputes must be attempted to be resolved in good faith within 30 days.
• If unresolved, disputes will be settled through arbitration in Santa Clara County, California under the rules of the American Arbitration Association.

7. Service Access & Limitations

We strive to provide uninterrupted service, but we may limit access if needed for maintenance or to prevent abuse.

8. Community Guidelines

Users must follow these guidelines:

• ✅ Be respectful: No harassment, hate speech, or abusive behavior.
• 🚫 No explicit content: Do not generate or share adult, violent, or offensive emojis.
• ⚠️ No political use: Emojis may not be used for political campaigns or election influence.
• 🔒 Privacy matters: Do not share personal data within the app.

Violating these rules may result in account suspension or termination.

9. Limitation of Liability

Emoti Craft is provided " as is " with no guarantees of uptime, accuracy, or error-free performance.

We are not responsible for:

• Loss of data, profits, or goodwill.
• Third-party service failures (e.g., Google Sign-In or payment processors).
• Any misuse of generated emojis by users.

By using the Service, you agree that any legal disputes or claims against us are limited to the amount you have paid for the Service.

10. Privacy & Data Protection

By using Emoti Craft, you agree to the Privacy Policy, which outlines how we collect and handle personal data.

11. Termination of Service

We reserve the right to suspend or terminate accounts that:

• Violate these Terms.
• Abuse or misuse the Service.
• Engage in illegal or harmful activities.

If your account is terminated, your access to Emoti Craft immediately ends, and no refunds will be issued.

12. Changes to This Agreement

We may update these Terms of Service at any time. Changes will be posted on this page, and continued use of Emoti Craft means you accept the updated terms.
